Until the Work is Done: What it Means to be an Exempt Employee

Duration: 90 Minutes
Employers must determine the employment status of all workers. Depending on the job duties and pay of a particular worker, an employer may classify the employee as "exempt" or non-exempt. This employment classification outlines the various rights and protections the worker is entitled to under the Fair Labor Standards Act (FLSA) and other employment and labor laws. You've likely seen these terms when filling out an application, noticed them in job postings and heard them used in conversation. But if you're like most people, the difference between the two categories is fuzzy at best.
FLSA Exemptions

Over the years, there has been a great deal of litigation related to exemption decisions. Employers who exempt positions must be prepared to defend each exemption decision, and may be subject to paying fines and back pay if they exempt positions that do not meet the requirements for exemption. In recent years, the number of court cases and the amounts of fines and back pay owed by employers has increased dramatically in this area, surpassed only by the fines and awards associated with discrimination lawsuits.

Why Should you Attend:
Most jobs are governed by the FLSA. Some are not. Some jobs are excluded from FLSA coverage by statute. Other jobs, while governed by the FLSA, are considered "exempt" from the FLSA overtime rules. This session will provide participants with resources to know which are which.

Objectives of the Presentation:
In this business climate where flexibility is a necessity and cross-functional terms are the norm, how do you define what jobs are exempt vs. non-exempt? What makes an exempt employee exempted from FLSA overtime law? It's a difficult task for your HR and payroll teams to sort out what's what. The most frequent mistake employers make in trying to comply with the Fair Labor Standards Act is misclassifying employees as exempt from overtime. This session will explore the major FLSA exemptions from overtime and help employers navigate this confusing area of the law.
