On February 24th,2018 U.S. Customs and Border Protection (CBP) has transitioned the filing and processing of drawback claims to the Automated Commercial Environment, taking what has been a largely paper process and making it completely electronic. On the same day, significant amendments to the drawback law ushered in by the Trade Facilitation and Trade Enforcement Act (TFTEA) has become effective, among other things allowing for more relaxed drawback substitution and a changed statutory timeframe. Since 1789, Congress has allowed importers to apply for refunds amounting to 99% of the duties paid on imported goods if those goods are later exported from the United States. This system, known as duty drawback, is intended to advance the interest of domestic production and promote a competitive export trade. The rule for application of certain types of drawback has undergone significant change effective February 24, 2018. Importers need to be aware about the new drawback regime and resulting refunds.
