Instructor Profile:
David L. Smith is a partner in Constangy's Atlanta office where he began his law practice in 1990. While his license is in Georgia, David actively practices occupational safety and health law across the country, representing and advising companies in a broad spectrum of industries on federal and state OSHA matters. His practice includes providing compliance advice to employers on the complex and often highly technical occupational safety and health requirements of federal and state OSHA agencies, as well as assisting employers with the development and implementation of safety and health programs and training necessary for a safe and compliant workplace. In addition to working with companies on programs and compliance, David assists and represents employers during OSHA inspections and in defense of OSHA complaints, citations, and retaliation charges. He also works with employers to develop and implement both general and DOT-required drug testing policies and to avoid and respond to DOT retaliation charges.

Having practiced OSHA law for over two decades, David has advised and successfully represented manufacturers of a wide range of products, large and small construction companies engaged in a variety of projects, agricultural and food production companies, restaurant chains, retailers both nationwide and regional, trucking and logistical service companies, and major airlines, among others. His OSHA law experience has included successful challenges to OSHA rulemakings, negotiation of ground-breaking corporate-wide settlement agreements, and investigation and defense of high-profile fatality and catastrophe cases. David also has extensive experience with combustible dust and ergonomics issues, as well as the various other issues on which OSHA has placed a strong emphasis, including most recently the safety of temporary workers.
