Compliance with the limitations of an Appraisal-Arbitration Provision of a Fire Policy

Duration: 90 Minutes
Appraisal is a form of alternative dispute resolution where the policyholder appoints a an impartial appraiser, the insurer appoints an impartial appraiser and the two appraisers appoint an umpire to resolve the limited issue of the amount of loss. Appraisal can be as informal as the two appraisers meeting an agreeing on the amount of loss to as extensive as a court trial with multiple witnesses called to testify before the appraisers. The appraisers must limit their work to the amount of loss and should never deal with issues of insurance coverage which is the sole province of the court.

Why Should you Attend:
Any person faced with a first party property claim who has reached an impasse and cannot reach agreement on the amount of loss must recognize the existence of the alternative dispute resolution provision of first party property policies called appraisal. If you have a dispute with your insurer over the amount of loss or if you are an insurer and have a dispute as to the amount of loss with a policyholder, appraisal is an important tool to quickly resolve the dispute.

Objectives of the Presentation:
To explain the appraisal provision of the policy and explain how the appraisal process works to establish a definitive amount of loss without presenting the dispute to a court for resolution. The presentation explains the methods by which appraisers work to establish the amount of loss, the limitations on what they can and cannot consider, and the methods used to present evidence the appraisers, and, after an award is rendered the right to convert the award into an enforceable contract.
