Internal investigations are complicated in that no investigation is exactly alike. Sometimes you just talk to a couple employees and sometimes you talk to dozens. It is not unusual for a seemingly small matter to blow up into a lawsuit. Often-single matter investigations offshoot into other, sometimes completely different and separate investigations. Retaliation during and after investigations is always a potential and very real (and expensive) likelihood. Investigators are often subject to pressure themselves. Compounding those problems is that emotions often run high during investigations and many employees, often with good reasons; either do not want to cooperate or are scared to be completely candid.

Without a framework from which to operate, such investigative challenges can throw even the most organized and logical person off track. However, there are best practices an employer can follow, as one shared denominator of investigations is the same - to find out the facts of a situation to determine a course of action to take - or not to take.

Having a set of processes to form the framework from which investigations proceed insures consistency, demonstrates competency, establishes that the employer takes such matters seriously and serves as a set of checks and balances for the investigator, whomever that may be, to follow.
